Someone in my family recently had to work through a custody dispute, and it made me wonder about the basic standard courts use. If both parents are capable and involved, why shouldn't 50/50 custody be the presumption? Judges could still adjust the schedule when circumstances genuinely make equal time unsuitable.

I found this Law Times piece on Bill C-560 useful: presumption of equal shared parenting . It gives some context on the debate. I’m curious whether starting from 50/50 could reduce conflict while still allowing exceptions when needed.
